18 August 2016 – Franchising demystified – the legals explained
Attendees were introduced to the legal elements of a franchise system including:
- the essential parts of the Competition and Consumer (Industry Codes – Franchising) Regulation 2014 (Cth) (Code) that need to be actively complied with;
- the documentation required to create a franchise including:
- the Disclosure Document;
- the Franchise Agreement (including the legal advice certificates);
- the Information Statement;
- the Operations Manual; and
- non-essential elements which can be utilised including payment guarantees and alternative franchising legal structures.
