Injunction for breach of confidence

Dundas Lawyers recently acted for a corporate client to restrain a former employee (and a contractor) from creating and promoting a competitive training program based on confidential information and copyright material belonging to one of our client’s entities.

After an extremely rigorous fact find involving a review of thousands of emails and documents and the preparation of a detailed chronology, we were able to file an application seeking an interim injunction to restrain the respondents from breaching contractual and equitable obligation of confidence and from breaching copyright.  The effect of this was to restrain these people from ‘poaching’ our client’s customers and eroding our clients customer base.

In this case the preparation of a detailed chronology was key as this enabled us to highlight not only the strengths in our client’s case but also the weaknesses so that alternative causes of action could be pursued and pleaded.

The chronology also formed the basis for the overall litigation strategy and the detailed assumptions that the legal cause of action was based on.
